1. Definitions
In these Terms and Conditions, the following definitions apply:
- "Service" refers to the residential care services provided by Mossvale
- "Resident" refers to any individual receiving care services at our facility
- "Family Member" or "Representative" refers to designated contacts and decision-makers for a Resident
- "We," "Us," "Our" refers to Mossvale
- "You," "Your" refers to the Resident, Family Member, Representative, or website visitor
- "Agreement" refers to these Terms and Conditions along with any residence agreement
2. Acceptance of Terms
By using our website, inquiring about our services, or entering into a residence agreement with Mossvale, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services or website.
Residents must be at least 18 years of age to enter into an agreement with Mossvale. For residents who lack capacity to enter into agreements, a legal representative or family member must agree to these terms on their behalf.
3. Service Description
3.1 Overview
Mossvale provides non-medical residential care services for elderly individuals in Pattaya, Thailand. Our services include accommodation, meals, daily assistance, and optional activities as described on our website and in individual residence agreements.
3.2 Service Availability
Services are provided subject to availability. We reserve the right to refuse admission if we determine that our facility cannot adequately meet an individual's care needs or if acceptance would compromise the wellbeing of existing residents.
3.3 Service Limitations
Mossvale is a residential care home providing daily support and assistance. We are not a medical facility and do not provide advanced nursing care, specialized medical treatment, or 24-hour medical supervision. Residents requiring such services should seek appropriate medical facilities.
4. Residence Agreement
Upon admission, residents (or their representatives) will enter into a separate residence agreement that specifies:
- Specific services to be provided
- Monthly fees and payment terms
- Duration of residency
- Termination conditions
- Resident responsibilities
- Emergency contact information
The residence agreement supersedes general website information and forms the primary contract for service provision.
5. Payment Terms
5.1 Fees
Monthly fees are as stated in the individual residence agreement. Fees cover services as specified and are payable in Thai Baht (฿).
5.2 Payment Schedule
Payments are due on the first day of each month in advance. Payment methods accepted include bank transfer, cash, and other methods as specified in the residence agreement.
5.3 Late Payment
Payments not received within 7 days of the due date may incur late fees. Continued non-payment may result in termination of services as outlined in the residence agreement.
5.4 Fee Adjustments
We reserve the right to adjust fees with 60 days' written notice. Fee increases will not exceed reasonable market rates for similar services in the area.
6. Resident Responsibilities
Residents (and their representatives) agree to:
- Provide accurate health and personal information
- Maintain respectful conduct toward staff and other residents
- Comply with facility policies and procedures
- Inform staff of changes in health status or care needs
- Ensure timely payment of fees
- Notify us promptly of any concerns or complaints
- Respect the property and belongings of others
- Follow reasonable health and safety protocols
7. Our Responsibilities
Mossvale commits to:
- Provide services as outlined in the residence agreement
- Maintain a clean, safe, and accessible environment
- Treat all residents with dignity and respect
- Communicate openly with residents and families
- Coordinate with external healthcare providers as needed
- Protect resident privacy and personal information
- Address concerns and complaints promptly
- Maintain appropriate staff levels for quality care
8. Health and Medical Care
Residents are responsible for their own medical care and should maintain relationships with appropriate healthcare providers. Mossvale staff will:
- Observe residents' general wellbeing
- Notify families of significant health changes
- Assist in coordinating medical appointments when requested
- Contact emergency services when necessary
We are not responsible for medical decisions, treatment, or outcomes. Residents and families should consult with qualified healthcare professionals for medical advice.
9. Termination of Services
9.1 Voluntary Departure
Residents may terminate services with 30 days' written notice. Fees are payable for the full notice period.
9.2 Termination by Mossvale
We may terminate services with reasonable notice if:
- A resident's care needs exceed our capabilities
- Payment obligations are not met
- A resident's behavior poses a safety risk to staff or other residents
- Terms of the residence agreement are materially breached
9.3 Immediate Termination
We reserve the right to immediate termination in cases of violence, abuse, or illegal activity. In such cases, no refund of prepaid fees will be provided.
10. Liability and Disclaimers
10.1 Service Provision
Services are provided "as is" with reasonable care and attention. While we strive to provide high-quality care, we cannot guarantee specific outcomes or results.
10.2 Limitation of Liability
To the extent permitted by Thai law, our liability for any claim arising from services provided is limited to the fees paid for services during the three months preceding the claim.
10.3 Personal Property
Residents are responsible for their personal belongings. While we take reasonable precautions, we are not liable for loss, damage, or theft of personal property.
10.4 Force Majeure
We are not liable for failure to provide services due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, or utility failures.
11. Privacy and Data Protection
Our collection, use, and protection of personal information is governed by our Privacy Policy. By agreeing to these Terms and Conditions, you also agree to our Privacy Policy, available at Privacy Policy.
12. Dispute Resolution
12.1 Informal Resolution
We encourage residents and families to communicate concerns directly with our management. Most issues can be resolved through open dialogue.
12.2 Governing Law
These Terms and Conditions are governed by the laws of Thailand.
12.3 Jurisdiction
Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Chon Buri Province, Thailand.
13. General Provisions
13.1 Entire Agreement
These Terms and Conditions, together with the residence agreement and Privacy Policy, constitute the entire agreement between you and Mossvale.
13.2 Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
13.3 Waiver
Failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision.
13.4 Assignment
You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations to a successor organization.
14. Changes to Terms
We may update these Terms and Conditions periodically. Changes will be posted on our website with a new "Last Updated" date. Continued use of our services after changes are posted constitutes acceptance of the revised terms. Material changes affecting current residents will be communicated in writing with reasonable notice.
